Understanding the Underwater Scooter Rental Waiver: What You Agree to Before You Ride

Before you zoom around the ocean on a sea scooter, there’s one vital task to tick off your list. The Participant Agreement, Release and Assumption of Risk. Underwater Scooter Rental LLC is located in Destin, Miramar Beach, Santa Rosa Beach and Sandestin, Florida. All participants must read and agree to this waiver prior to utilizing the company’s equipment. In this article I break down what the waiver states in layman’s words so you know what to anticipate before you book.

Why There Is a waiver

The firm wants you to have a fantastic experience yet the waiver is there for your safety and theirs. There are some inherent dangers in Underwater Scooter and Personal Watercraft activities which cannot be eliminated without altering the nature of the activity. You are required to read and accept the conditions of the waiver before you may use the facilities or services. If you are unable or unwilling to sign you may have fun watching others but you cannot take part in any activity yourself.

Assumption of Risk

The first part is the assumption of risk. By signing you agree that participation contains known and unknown risks which might result in harm (physical or emotional), paralysis, death, damage to yourself, to property or to third parties.

There are numerous instances of waiver. These include slips and falls, being jolted or thrown about during rides, accidents with objects, automobiles or other boats and unintentional drowning. Also noted are wet and slippery conditions while boarding or disembarking a vessel. Also discussed are forces of nature: harsh weather, lightning, quick changes in the weather, the sun, strong winds, frigid temperatures, huge waves, currents, tides and surf. Cold-water shock, hypothermia, heat fatigue, sunburn and dehydration are all mentioned.

It goes on to include harmful fauna, pest stings, deadly flora and hostile or poisonous aquatic life. Injuries may range from sprains, bruises and scratches to shattered bones and injuries to the head, neck, back and internal organs. It also refers to equipment malfunction, operator mistake, the neglect of those around you and your own physical state and effort. It also covers loss of or separation from partners, exposure to infectious illnesses, transportation accidents and occurrences in remote regions without medical services.

Participation is voluntary and Safety Gear

The second line says your involvement is entirely optional. You know the dangers and you consent to participate. You also agree to wear a U.S. Coast Guard authorized personal flotation device (life jacket) and a wetsuit bottom or other gear providing equal protection for the duration of the activity.

Release and Indemnity

In the third section, you release USR willingly and forever from all claims, demands or causes of action relating to your participation or your use of its equipment or facilities. These include accusations that the Company was negligent in its activities or omissions. You also agree to indemnify and hold USR harmless in turn. The Release is executed by you on behalf of yourself, your spouse, children, parents, heirs, assigns, personal representatives and estate.

“USR” is widely defined. This includes Underwater Scooter Rental LLC and its agents, owners, officers, volunteers, employees and anybody operating for or on behalf of Underwater Scooter Rental LLC.

Attorney’s Fees, Insurance and Governing Law

There are three brief sections on practicalities.

Attorneys’ fees.

You agree that if USR or anyone acting on USR’s behalf must pay legal fees and expenses to enforce the agreement, you will pay such costs.

Insurance.

You warrant that you have enough insurance cover for any harm or damage you may cause or receive during participating. You otherwise agree to pay such charges yourself. You also agree that you will take on the risk of any medical or physical conditions you may have.

Governing law.

If you sue USR you agree that you will sue solely in Florida and that Florida substantive law will apply. If any portion of the agreement is deemed to be invalid or unenforceable, the remainder shall remain in full effect.

Acknowledgement

The acknowledgement page provides a reminder of what signing entails. If you are injured or your property is harmed while participating, a court can rule that you have given up your right to sue USR for the claims you have relinquished. You also agree that this material is good for future visits and involvement. By signing I certify that I have had enough time to read the whole agreement, that I understand it and that I accept to be bound by its provisions.

Perpetual Release and Waiver

The waiver is valid for all dates of participation. Once you sign it, you don't have to sign a new one each time you rent.

Notice to Natural Guardian of Minor Child

When the waiver involves a minor child, there is a separate notification to the natural guardian of the child. It tells you to read the form all the way through and carefully, since you are committing to allow your kid participate in an activity that might be harmful.

The notification states that although the firm has taken reasonable precaution, your child may be gravely harmed or killed because certain threats cannot be prevented or eliminated. By signing, you give up your child's right, and your own, to sue the firm for bodily harm, including death, or property damage arising from the risks that are a normal part of the activity. You don’t have to sign, but if you don’t, the firm doesn’t have to allow your kid to participate.

Contract of Guardianship

The guardian agreement further reiterates that all hazards can never be eradicated and that inherent danger exists in involvement. That means mild and major, temporary and permanent harm of every sort, inflicted by your kid or caused by others. You bear all responsibility and financial expense for any injuries or harm to your kid or children by signing.

It makes three commitments:

  • You waive, release and dismiss the firm and its members, managers, directors, officers, agents, employees, volunteers, representatives and linked entities from any and all claims relating to your or your child’s participation, including claims arising from their own carelessness.
  • You agree to indemnify and keep them blameless from any loss, liability, claim, expense, damage, or judgement arising out of your child’s involvement, including any claim claiming their own carelessness.
  • You accept that this agreement is ever in the future and applies every time your children come, whether at the present location or any other.

Where and how to sign

The waiver page is for your viewing. The booking includes a signature page where you input your legal name, specify any youngsters in your group and sign on screen before paying. This way the paperwork is done before your rental day.

Conclusion

The waiver is extensive, but the message is straightforward. Sea scooter and personal watercraft fun have serious hazards. By signing you agree to accept those risks, agree to wear a life jacket and wetsuit bottom or comparable apparel and release the firm from all claims related to your participation. Parents and guardians agree to the same agreements on behalf of their children. Read the document fully before you book and there are no surprises on the day.
